Reconstructing Judaism and the Reconstructionist Rabbinical Association joined Americans United, ADL, and a variety of other religious and civil liberties organizations in an amicus brief opposing overbroad accomodation of employers refusing to participate in the Affordable Care Act’s requirements regarding contraception coverage. The U.S. Constitution’s Establishment Clause forbids the government to shift the costs and burdens of objectors’ religious beliefs onto third parties, and an accommodation without a demonstrated substantial burden on religion is an unconstitutional religious preference.
