Reconstructing Judaism and the Reconstructionist Rabbinical Association signed onto an amicus curiae brief challenging religious organizations’ claim to exemption from providing, and power to block access to, women’s contraceptive services for their employees. The brief argues that under the Establishment Clause of the U.S. Constitution, the government cannot create religious exemptions that violate the rights of third parties, nor exemptions where there is no government-created undue burden on religious exercise. Reconstructing Judaism believes both in the importance of the separation of church and state and that the reproductive rights of women must be preserved and protected.
